365 CAR RENTAL - TERMS AND CONDITIONS

Welcome to 365 Car Rental! By using our services, you agree to the following Terms and Conditions. Please take the time to carefully review them as they outline important details regarding your rental agreement, rights, and responsibilities.

  1. DEFINITIONS:
  • Owner: 365 Car Rental, headquartered in Bel Ombre, Mahe, Seychelles (hereinafter referred to as "365 Cars"). Contact details: bookings@365cars.sc ; +248 2636561.
  • Renter: Any individual or entity renting a vehicle from 365 Cars.
  • Operator: The person collecting and driving the vehicle, either as the Renter or someone authorized by the Renter.
  • Additional Operator: Any authorized person(s) listed in the Rental Agreement besides the main Operator.
  • Unauthorized User: Any individual, not listed in the Rental Agreement, who is prohibited from operating the vehicle.
  • Third Party: Any individual other than the Renter, Operator, Additional Operator, or 365 Cars. This includes pedestrians, passengers or others involved in traffic incidents.
  • Vehicle: The car specified in the Rental Agreement, provided by 365 Cars for use during the agreed rental period.
  • Start of Rent: The date and time when the vehicle is collected by the Renter.
  • End of Rent: The date and time when the vehicle is returned to 365 Cars.
  • Collecting and Returning Point: The designated locations listed in the Rental Agreement 365 Cars office where the vehicle is to be collected and returned.
  • Rental Agreement: The contract between the Renter and 365 Cars outlining the non-exhaustive terms of the rental.
  1. GENERAL RENTAL TERMS:

By reserving and collecting a vehicle, the Renter agrees to the following conditions:

  • The Renter must be at least 18 years of age and possess a valid driver’s license for a minimum of one year. The driver’s license must permit operation of the vehicle category being rented.
  • The Renter must provide valid identification (e.g., passport, driver’s license) at the time of vehicle collection and 365 Cars reserves the right to retain copies for internal use.
  • If the Renter is a legal entity, the person collecting the vehicle must be duly authorized and both the entity and the individual are jointly liable for adhering to these terms.
  1. RESERVATION PROCEDURE:

To reserve a vehicle, the Renter may:

  • Visit our website at www.365cars.sc or contact us via email or phone.
  • The Renter will be required to choose the pick-up/drop-off dates and locations, vehicle type, and any optional extras (e.g., child seat, GPS etc..).
  • After entering personal and payment details, the Renter must confirm acceptance of our Terms and Conditions.
  • Once a reservation is confirmed, a confirmation email will be sent, including details such as rental period, vehicle type, and total cost. The reservation number serves as proof of contract.
  1. MODIFICATION AND CANCELLATION OF RESERVATIONS: 
  • Modification: The Renter may modify a reservation up to 24 hours before the scheduled Start of Rent. All modifications are subject to vehicle availability and may incur additional costs if the rental duration or vehicle class changes.
  • Cancellation: Cancellations must be made at least 24 hours before the rental start date to avoid penalties. Cancellations made less than 24 hours in advance may result in a charge equivalent to one day’s rental fee.
  • No-Show: If the Renter fails to collect the vehicle without prior notice within 3 hours of the agreed collection time, the reservation will be automatically cancelled, and the Renter will be charged a no-show fee.
  1. RENTAL PRICING AND PAYMENT TERMS:
  • Basic Rental Price: The rental price generally includes the use of the vehicle and basic third-party liability insurance.
  • Additional Costs: Optional services such as child seats, additional drivers or insurance packages will be charged separately. Additional fees may apply for late returns, fuel surcharges or returning the vehicle to a different location than agreed.
  • Payment Methods:365 Cars accepts internationally recognized credit cards, including Visa, Mastercard, and Union Pay. Payment for the rental period and any additional services must be made before or at the time of collecting the vehicle.
  1. PREAUTHORIZATION:

365 Cars does not take any deposit or preauthorization on your credit or debit card. However, you remain fully liable for any damages, fuel surcharges, or traffic violations incurred during the rental period. If you have opted for Collision Damage Waiver (CDW), your liability will be limited in accordance with the CDW terms, but you will still be responsible for certain exclusions such as damage to tires, rims, undercarriage, interior, or glass.

  1. COLLECTING AND RETURNING THE VEHICLE:
  • Collecting the Vehicle: The Renter must inspect the vehicle at the time of collection and report any pre-existing damage. By signing the Rental Agreement, the Renter confirms that the vehicle is in good condition and roadworthy.
  • Returning the Vehicle: The vehicle must be returned in the same condition as collected, with the same fuel level. Additional charges will apply for vehicles returned with less fuel or in a damaged or excessively dirty state.
  • Late Returns: If the vehicle is not returned by the agreed time, 365 Cars reserves the right to charge additional rental days, late fees, and any associated administrative costs.
  • After-Hours Returns: Returning the vehicle outside office hours is possible with prior arrangement and may incur an additional fee.
  1. USE OF THE VEHICLE:

The Renter agrees to the following:

  • Proper Use: The vehicle must be driven responsibly, adhering to all local traffic laws. The Renter is prohibited from using the vehicle for commercial purposes, towing, racing, or any illegal activities.
  • Authorized Drivers: Only the main Operator and any Additional Operators listed in the Rental Agreement are authorized to drive the vehicle. Unauthorized drivers are strictly prohibited.
  • Safety: The vehicle must be parked in secure locations, locked when unattended, and all security features must be activated. The Renter is responsible for any loss or theft resulting from negligence.
  • Prohibited Uses: The Renter may not use the vehicle for off-road driving or transport goods or passengers exceeding the manufacturer’s specifications.
  1. INSURANCE AND LIABILITY:
  • Basic Insurance: All vehicles are insured for third-party liability in accordance with local laws. This covers damage to third-party property or injury to third parties.
  • Optional Insurance Packages:
    • Collision Damage Waiver (CDW):Reduces the Renter’s liability for damage to the vehicle. However, it does not cover damage to tires, rims, undercarriage, interior, or glass.
    • Theft Protection (TP):Limits liability in case of vehicle theft.
    • Full Protection Package: Covers damage to wheels, undercarriage, glass, and theft. It may also include personal accident insurance for the Renter and passengers.
  • Exclusions: Insurance does not cover damage caused by misuse, negligence, or illegal activities (e.g., driving under the influence, unauthorized drivers). The Renter is fully liable for any damage under these circumstances.
  1. TRAFFIC VIOLATIONS AND DAMAGE REPORTING:
  • Traffic Violations: The Renter is responsible for all traffic and parking violations incurred during the rental period. 365 Cars may charge an administration fee for handling any fines or penalties.
  • Damage Reporting: In the event of an accident or vehicle damage, the Renter must immediately inform 365 Cars and the local authorities. A police report must be obtained in cases involving third-party damage, theft, or accidents.
  • Unauthorized Repairs: The Renter must not attempt any vehicle repairs without prior authorization from 365 Cars.
  1. LIMITATION OF LIABILITY:
  • Renter’s Liability: The Renter is responsible for any damage or loss resulting from improper use, negligence, or violation of these terms. The Renter will be charged for all associated repair costs, administrative fees, and lost rental income during the repair period.
  • 365 Cars’ Liability:365 Cars is not responsible for any personal property left in the vehicle, nor for any indirect, incidental, or consequential damages incurred by the Renter during the rental period.
  1. TERMINATION OF THE AGREEMENT:

365 Cars reserves the right to terminate the Rental Agreement immediately if the Renter breaches any of the terms outlined. In such cases, 365 Cars may repossess the vehicle without notice and charge the Renter for any costs associated with the termination.

  1. GOVERNING LAW AND JURISDICTION:

This agreement is governed by the laws of the Republic of Seychelles. Any disputes arising from the rental or these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of Seychelles.
